Processes for terminating a marriage

The state of Ohio allows marriages to be terminated via dissolution, legal separation or divorce.

Dissolution — Often equated to no-fault divorce, dissolution is quicker and easier than divorce. Both spouses must agree on all terms, including alimony, child support, custody and division of assets. Once everything has been agreed upon, a petition is filed, attaching a separation agreement, the terms about which spouses ultimately testify are acceptable and the dissolution of marriage is granted.

Legal separation — Many people choose legal separation instead of divorce because they haven’t met the six-month residency requirement in Ohio, they object to divorce on religious grounds or they want their spouse to remain responsible for their support, such as might be available through ongoing medical insurance coverages.

Divorce — This is the most complex of the three options and takes the most time to complete.

Divorce in Ohio begins with a spouse filing a complaint in the domestic relations division of the local common pleas court. The complaint must state the grounds for the divorce. Grounds for divorce in Ohio include:

  • Adultery
  • Gross neglect of duty
  • Bigamy
  • Extreme cruelty
  • Fraud
  • Habitual drunkenness
  • Imprisonment
  • No-fault — spouses have lived apart, without cohabitation,  for one year
  • No-fault — incompatibility

Settlement is usually quicker, easier and less stressful for all parties involved, especially if there are children. Unfortunately, and for a number of reasons, settlement isn’t always obtainable.
